E90 330D EDC16 euro3 egr?

So, i've come across a supposed euro3 file for E9x 330D, it does seem to lack DPF. I'm curious if it does use EGR also, or does the euro3 lack EGR? It didn't appear to throw a Check Engine Light with the vacuum line unplugged from EGR valve.
Also, am i correct in assuming that the euro3 file does not use the "throttle body" that is before EGR valve?

It uses egr for sure

find egr hysteresis maps and you can do egr off

Okay, strange that it does not throw a CEL with the egr unplugged though.
Can anyone confirm that this actually is an EURO3 file or perhaps it's just a modified file?
